Ho’okipa Events Terms and Conditions
Please read these Terms & Conditions carefully. Ho’okipa Events strives to make every wedding/event as perfect as it can be so that you can cherish these priceless moments for a lifetime. Understanding the items below will help us work together to make that possible. Please feel free to contact us directly with any questions. These terms and conditions constitute an agreement between you as the client and Ho’okipa Events. These terms and conditions are binding upon payment of the deposit by the client.
Bookings, Cancelations, Modifications, Deposits, and Payments
All bookings and modifications must be submitted to and confirmed by Ho’okipa Events in writing (email or mail). Deposits are required for all services and/or packages and are non-refundable. The final balance is due and payable no later than 30 days prior to the wedding date unless otherwise noted. Cancellations and package modifications (including additions and deductions) must be submitted in writing and approved by Ho’okipa Events at least 30 days prior to the wedding/event date and are subject to a 4% processing fee. No refunds will be issued on cancellations made within 30 days of the wedding date. Modifications to a package of less value following the payment of the deposit are not permitted. Once full payment is received, no modifications will be allowed.
Due to the significant amount of time that must be reserved for any special requests, we do not allow these packages to be downsized, unless a request is made in writing and approved by Ho’okipa Events at least 90 days prior to the wedding/event date.
Payment for all services is due 30 days prior to the event unless otherwise noted. All policies, packages, and pricing are subject to change without notice. While we make every effort to maintain prices as quoted, they are subject to change without notice. All transactions are subject to a 21% Service Fee, and 20% Gratuity, subject to applicable sales tax + a 4% processing fee. Service Fee’s are not gratuity. Service Fee’s are used to pay for management, staffing & expenses.
Wedding/Event Details
Ho’okipa Events will work with you to plan each detail that you desire for your wedding/event. To facilitate this process, we ask that all specific requests be submitted in writing (email or mail) not less than 30 days before the wedding/event date so that we can work to make your wedding/event as perfect as it can be. Please give thought as to your preferences for venues, entertainment, timing, and other particulars that you would like. Please submit your final attendance numbers no later than 30 days prior to your wedding/event date. All selections and details are subject to change from time to time in the sole discretion of Ho’okipa Events.
Photography/Videography Release
Ho’okipa Events reserves the right, and the client irrevocably consents and authorizes Ho’okipa Events to use, reproduce publish and copyright each of the names, likenesses, images, voices, and performances, in whole or in part, any and all film footage, prints, photographs and/or other media taken during the wedding ceremony and/or reception. You understand that the media, negatives, copies or reproductions shall be the sole property of Ho’okipa Events, to be used and disposed of in commerce or otherwise, with or without compensation to Ho’okipa Events, in perpetuity and without limitation. You hereby waive any right to inspect or approve the finished product or the use to which it may be applied. You agree to release and indemnify Ho’okipa Events from and against any and all claims for invasion of privacy, defamation and any other cause of action, including without limitation all attorneys’ fees and costs reasonably incurred in connection therewith, arising out of the production, publication, display and exhibition or use of their likeness, image, voice, interview and performance.
Circumstances Beyond the Control of Ho’okipa Events
It is understood and agreed that Ho’okipa Events, its employees, agents, or contractors performing hereunder shall not be held liable, and Ho’okipa Events denies responsibility in the event a scheduled wedding, reception or event cannot take place or is delayed due to circumstances beyond its control. In the event of weather conditions, road conditions, traffic, mechanical difficulties, strikes, lockouts, riots, global pandemic or for any reason whatsoever, Ho’okipa Events may at any time and without prior notice cancel, advance, postpone or deviate from any scheduled event and shall not be liable for any loss whatsoever incurred by reason of such cancellation, advancement, postponement or deviation. You understand and accept all risks associated with unforeseen circumstances and other items beyond your and Ho’okipa Events’ control.
Marriage License
Wedding couples are responsible for obtaining a marriage license prior to their event (this document cannot be obtained by anyone other than the wedding couple). Wedding couples who fail to obtain this document understand their service will carry no legal value. Ho’okipa Events provides instructions to obtain the document in the reservation confirmation and website at www.hookipaevents.com/himarriagelicense.
Venue Restrictions
Ho’okipa Events is not responsible compliance with or the existence of any venue restrictions, including but not limited to, restrictions on open flames, sand, rice or other toss items, and decorations such as rose petals and other floral and non-floral décor, and is not responsible for any adverse impact on the ceremony/event as a result of such restrictions. For all public permitted venues, Ho’okipa Events does not permit any outside decorations or setups, such as, but not limited to, any arches, chairs or tents. All locations are entered at the individuals own risk. Ho’okipa Events is not liable should any individual associated with the wedding party or guests of wedding party suffer an injury or become physically ill.
Sound and Entertainment
Ho’okipa Events is not responsible for any sound or music services used during the ceremony, reception, or other event, including amplification for the officiant, clients, readers and/or musicians. In the event that the client uses the sound equipment provided by Ho’okipa Events or its vendors, they understand that they are not professional sound engineers and the equipment is not a substitute for professional sound equipment.
Event Vendors & Partners
In the event of an emergency or unexpected circumstance preventing an Event Vendor and/or Partner from performing his or her services, Ho’okipa Events shall in its sole discretion provide a replacement Event Vendor and/or Partner if necessary, without the clients’ prior approval.
By booking the specific services for your wedding/event, you agree that the wedding/event shall begin at the specified time booked. Scheduled Event Vendors and/or Partners must be able to begin their services at the scheduled time in order to stay on schedule for other scheduled weddings and events. You understand and agree that you may be charged additional fees and costs if the Event Vendor(s) and/or Partner(s) must wait to start their services past the scheduled time, and further that no scheduled Event Vendors and/or Partners are required to stay past the scheduled time of completion for the event.
Limitations of Liability
To the maximum extent permitted by law, and not withstanding any other provision of this Agreement, the you agree to limit the Company’s liability for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorneys’ fees and costs and expert witness fees and costs, so that the total aggregate liability of Ho’okipa Events shall not exceed the total costs paid for the wedding package and additional services purchased. You further agree to indemnify, defend and hold harmless Ho’okipa Events and its employees, agents, independent contractors, officers, directors, members and/or managers for any injury, property damage, liability, claim or other cause of action arising out of or related to your actions or the actions of your guests.
Additional Terms
You agree that these terms and conditions and the transactions between you and Ho’okipa Events are subject to, and shall be interpreted and governed by the laws of the State of Hawai’i and that the parties hereto agree that any legal action taken by either party shall be instituted and prosecuted in the Circuit Courts of the First Circuit, State of Hawai’i. You further agree that the prevailing party shall be entitled to reimbursement by the non-prevailing party of all reasonable attorneys’ fees and costs incurred.
These terms and conditions constitute the entire agreement between the parties, and supersede all prior agreements whether oral or written concerning the subject matter of this agreement. By placing a booking and paying a deposit, you understand these terms and conditions and agree to be bound by them.
